BCCI moves SC against Bombay HC order quashing probe panel

The Board of Control for Cricket in India (BCCI) on Monday moved the Supreme Court challenging the Bombay High court order holding as illegal the judicial panel appointed by the Board to probe into allegations of betting and spot fixing in IPL matches.

In its special leave petition, the BCCI said the probe panel’s appointment was legal and as per the Board’s rules and regulations. It said the High Court’s finding that the Board did not follow the rules was erroneous. The High Court ought not to have entertained the public interest petition as no fundamental rights of the petitioner had been violated. Further the PIL petitioner, the Cricket Association of Bihar, was not a BCCI member. The Board, while seeking to quash the High Court order, sought an interim stay of its operation.

Meanwhile the Cricket Association of Bihar also filed a caveat in the Supreme Court to prevent passing of ex parte orders and to ensure that it was heard by the court before any order was passed.
